These standard terms of sale apply to the contract entered into between JEANNE • CHAVANY (SAS FM2CM) registered at the Lyon (France) Company Register, under No. 800329526 RCS (hereinafter referred to as “JC”) and the consumer, the client of the online boutique www.jeanne.chavany.com (hereinafter referred to as the « Client »).
For these purposes, « consumer » shall imply any natural person acting for the satisfaction of her/his personal needs, to the exclusion of any professional needs.

The purpose of these standard terms is to define the contractual conditions applicable to the sale of the JEANNE • CHAVANY leather products at www.jeanne.chavany.com
These standard terms are supplemented by the order form, completed online by the Client, all of which together form the sales contract entered into between the parties.

CHARACTERISTIC OF THE PRODUCTS OFFERED

The products offered (hereinafter the « Product(s) ») are those appearing in the catalogue published on the pages of the online boutique www.jeanne.chavany.com.
Each product is accompanied by a detailed description prepared by JEANNE • CHAVANY . Although the catalogue’s photographs are as accurate as possible, JEANNE • CHAVANY cannot guarantee the accuracy and precision of the material presented. Consequently, the color of the requested product may marginally vary.

Characteristic of the products offered

A Buyer wishing to purchase a Product must:

  • Complete the online order form, selecting each of the references detailing the Products chosen, in accordance with the process indicated. The Client is entitled to change her/his mind at any time in order to modify her/his selection;
  • Provide her/his client number, or complete the identification information and the desired delivery address;
  • Confirm her/his order, upon having reviewed it;
  • Provide payment in the conditions stipulated in the « Payment » article below.

Confirmation of the order expresses the Client’s acceptance of JEANNE • CHAVANY offer appearing on the order form, as well as the Client’s acceptance of these general terms of sale.

JEANNE • CHAVANY will acknowledge receipt of the order by sending an e-mail to the Client’s e-mail address.
JEANNE • CHAVANY reserves the right not to accept an order if it believes that the Client is not acting as a consumer or may be insolvent, or if JEANNE • CHAVANY suspects fraud.
All orders placed on www.jeanne.chavany.com will be archived for a minimum time period of 10 years.

Pricing Policy

The prices appearing in the online catalogue are expressed in EUROS. Prices are understood to include all taxes on the date of the order.
The price of the Products include delivery expenses, however the cost of return are the responsibility and charge of the customer.
Any customs duties and taxes other than value-added tax are not included and are the responsibility of customer.

Payment

Products are required to be paid in full at the time of the order.
Payments must be made by credit card or via Paypal; payments will be made using the online payment platform of Paypal, to which the client will be automatically directed.
The Client is informed that JEANNE • CHAVANY requires the use of the 3D Secure or Verified by Visa security mechanisms, depending on the Client’s card. The Client must ask her/his bank for access to these services.
The buyer’s account will be debited on the date of the order.
A hardcopy invoice, indicating the invoice’s payment, will be sent to the Client with the package containing the Product.

Reservation of title

The Products shall remain property of JEANNE • CHAVANY, until they have been paid in full.

Shipping and delivrery

The Products are delivered by an express delivery carrier, to the address indicated on the order form. The Client may request that the Product be delivered to a third party, to the latter’s address. JEANNE • CHAVANY does not accept orders having as a delivery address post office box.
JEANNE • CHAVANY will inform the Client once the Product has been dispatched, and will indicate if a package tracking mechanism is provided on the carrier’s website.

The deadline by which JEANNE • CHAVANY commits to deliver the Product will be sent by email to the buyer.

JEANNE • CHAVANY shall immediately inform the Client if it is aware that it is possible that the Products will not be delivered by the announced delivery date.
If the indicated delivery deadline is surpassed by more than seven days, the Client shall be entitled to ask JEANNE • CHAVANY to cancel the sale. This request must be made by registered mail with return receipt. The Client shall be reimbursed in the same conditions as those stated in the cancellation stipulated in the article below.
The cancellation stipulated in this article is only applicable to Clients whose primary residence is in the European Union.
In the event of damages during transport, a reasoned complaint must be made to the carrier within three days of the delivery.
If the Product ordered is unavailable, JEANNE • CHAVANY shall inform the Client by e-mail. The Client will then be reimbursed without delay and, at the latest, within thirty days from the payment of the amounts that s(he) has paid. Thereafter, these amounts shall accrue interest at the official rate. Delivery times and shipping costs applied to products purchased on the JEANNE • CHAVANY website:

Please note that any order made after 1pm (GMT +1) on Friday and throughout Saturday and Sunday will be dispatched for delivery on the Monday of the following week. French national holidays, bank holidays in the shipping destination countries can also lead to delays in deliveries.

In order to guarantee security and speed, all orders are shipped using high quality courier services. Once your order has been dispatched, you will receive a tracking number and a direct link by email that will allow you to check the status of your order and follow its progress at the courier´s website.

Deliveries are made between 8am and 6pm and will require a signature to ensure safe and secure delivery of your order.

returns and exchanges

For all products purchased on www.jeanne-chavany.com in the event that a shipment is either not conform to the ordered product or defective, customers have fourteen (14) calendar days following the shipment date to exchange it for an alternate item or be reimbursed.
Returned products must be:

  • In their original state new and never worn
  • In their original packaging
  • Accompanied by the original invoice or a copy of the invoice
  • Accompanied by an explanation for the return

Made-to-measure items that have been personalized by the customer or dimension specifications cannot be returned or exchanged.

Refund for your order will be made within 14 days following our teams’ reception of the returned product.

right of widthdrawal

The benefits of this article solely apply to Clients whose primary residence is in the European Union.
The Client shall have a period of seven days following delivery to cancel her/his order, without having to indicate the reason, and without having to pay a penalty, with the exception of return expenses. The Client can also exercise her/his right to cancel before her/his order is dispatched.
In this event, the Client will be responsible for returning the product to the JEANNE • CHAVANY address indicated.
Returned products must be:

  • In their original state (new, never worn)
  • In their original packaging
  • Accompanied by the original invoice or a copy of the invoice

If the Product is to be delivered to a third-party, the latter can only request an exchange. No reimbursement can be made to a third-party recipient in the event of a difference of price. The Client maintains her/his right to cancel, regardless of the circumstances.

In compliance with the article L.121-21-4 of the consumption code, the products will be refunded to the customer within 14 days of the request date, through the same payment method initially used by the consumer. Thereafter, the amount due shall accrue interest at the official rate in effect. Reimbursements are made by crediting the credit card with which the Client paid for the Product.

The shipping is free of charge, the cost of return are the responsibility and charge of customer.

WArranties

The Products are covered by the legal warranty of conformity provided for by Articles L.211-1 et seq. of the French Consumer Code [le code de la consommation]. This warranty must be mentioned by the Client within two years from delivery.

Any variation in color from the selection made on the purchase day will be considered conform.
The Products are also covered by the hidden defect warranty provided for by Article 1648 of the French Civil Code [le Code civil]. This warranty must be mentioned by the Client within two years from the discovery of the defect.

JEANNE • CHAVANY shall not be responsible for the deterioration of a Product that has been used by the Client in a manner inconsistent with its intended use, or in a manner inconsistent with JEANNE • CHAVANY’s recommendations.
In order to conserve their quality and appearance, JEANNE • CHAVANY leather:

  • Must never be immersed in water and, more generally, must not be exposed to any liquid.
  • Are not intended to be worn while engaging in sports activities.

JEANNE • CHAVANY uses leather and lining, complying with the Reach regulations and therefore cannot be held responsible for any reactions or allergies.

liability

JEANNE • CHAVANY is bound by a best efforts obligation with respect to the online selling process; it cannot be held liable for damages resulting from the use of the Internet network, such as lost data, intrusion, the action of viruses, or a service interruption.

JEANNE • CHAVANY shall not be responsible for the non-performance or improper performance of this online sales contract if this non-performance or improper performance is attributable either to the consumer, or to the unforeseeable, unstoppable act or fault of a third-party, or to a force majeure situation.

Intellectual property

All of the products and components of the JEANNE • CHAVANY online boutique are and shall remain the exclusive property of JEANNE • CHAVANY .
It is expressly prohibited to represent, reproduce or reuse, in any form whatsoever, including partially, components of the site, including, but not limited to, software programs, visuals or sound elements.

Personal data

JEANNE • CHAVANY collects and processes the personal information provided by the Client, solely for the purposes of completing the Client’s order. JEANNE • CHAVANY shall be entitled to send the Client e-mails, in order to inform the Client of changes to its catalogue. The Client shall be entitled to request to no longer receive these solicitations, by clicking on the link provided for this purpose.

The processing constituted by the JEANNE • CHAVANY online boutique has been declared to the “CNIL” [France’s national Data Processing, Files and Individual Freedoms entity] on 22/04/2016, registered under the number 1950769 v 0.
In accordance with the provisions of French Act 78-17 of 6 January 1978 concerning data processing, files and freedoms, the Client has the right to access and rectify the information processed by JEANNE • CHAVANY concerning her/him. Agreements of proof

These standard terms, the order form confirmed by the Client, the invoice, and the information recorded at the time of the Client’s placement of the order, shall be kept by JEANNE • CHAVANY on an electronic medium containing a mechanism ensuring the integrity of said information.
The aforementioned electronic recordings shall be deemed by the parties as proof of the communications, order and online selling contract entered into between the two parties.
The Client agrees to receive the various communications referred to in these standard terms, in particular, concerning the delivery and return of the Products, by e-mail, to her/his address declared at the time of the order.
If the Client chooses to contact JEANNE • CHAVANY by e-mail, s(he) agrees that the latter will use e-mail to reply to her/his email communication.
